Define Regulations
President Reagan said the following in the 1970’s:
“All government agencies can pass regulations that have the force of Law. The difference is when you break the law, you are innocent until proven guilty. When you break a regulation, you are guilty and must prove your own innocence”.
Needless to say that regulations have been a problem for Americans, not only from the 1970’s but also since the 1770’s as well. Why hasn’t this problem been addressed? Simply put, politicians want a way to control the People without being accountable.
The BIG question: How do we stop out-of-control regulations? There is no question that regulations are a necessary part of enforcing law, however, the next question that We-The-People must ask is how does that regulation pertain to any given Law?
Therein lies the solution to out-of-control regulations. Simply define, or redefine, that regulations must and can only exist in support of a specified law. Most importantly, require Legislative action to incorporate the regulation into the laws they were intended to enforce. And set time limits on the Legislative action that if not met, would render regulation null and void when Legislative bodies fail to take action.
Most likely this type of change will be in the form of a Constitutional Amendment, either in every State or to the United Stated Constitution. No Politician will ever allow one of the most useful tools in the government arsenal for Power over the People to be taken away willingly. (Keep in mind that the only difference between and Politician and a Representative of the People is that only a Politician will tell you there is no difference.) Which is why the convention of the States is probably the only way that there is a chance for this kind of Amendment along with Amendments like Term Limits will happen.
28th Amendment
All Governments shall not make any regulation that does not support the enforcement of law. All regulation becomes null and void if not incorporated into the law they were designed to enforce within 180 days. All regulation existing before the ratification of this amendment that does not enforce a law is null and void. No regulation shall be used to enforce a law different from the law that specified the regulation.
In both High School and College, I occasionally enjoyed watching Johnny Carson on the Tonight Show. I was lucky enough to see President Reagan as a guest. Below is that section of the Tonight Show where he talks about regulations and government being the problem that we are all facing today.
We may never get rid of Regulations, however, We-The-People can define and limit what Regulations can do. A clear and concise definition of what a Regulation is would be a “Founding Father Level” change that America has needed since Politicians said there is no difference be Politicians and Representative of the People.
