Oregon Supreme Court Overturn
The House of Representatives shall have the sole authority within the Government to overturn an Oregon Supreme Court ruling or decision and shall be done by a simple majority vote that cannot be prevented by any internal action of the Legislature. The House of Representatives shall be required to vote within ninety days of the challenge to an Oregon Supreme Court ruling or decision. After ninety days if the ruling or decision is not overturned, the ruling or decision shall stand.
The Governor, Speaker of the House of Representatives, or the Minority leader of the House of Representatives shall be the sole authorities within the Government to bring to vote within the House of Representatives a challenge to a Supreme Court ruling or decision.
The People, threw initiative process, shall have the authority to overturn an Oregon Supreme Court ruling or decision and shall be granted 180 days to collect the require signatures for State wide referendum. The ruling or decision shall stand if the required signatures are not submitted within the 180 day from the ruling or decision.
A challenge to an Oregon Supreme Court decision or ruling must be made within 90 days of the Legislature being in session after the ruling or decision is handed down and not based on the calender. A challenge shall not be allowed for criminal or punitive cases.
A period of five years shall be allowed from the time of the ratification of this amendment to review cases going back a maximum of 30 years.
The Oregon Supreme Court can been seduced by a very small number of people into making decisions that are not based on the Oregon Constitution or undue political influences.
Such seditions have become, over the last 50 years, easier to accomplish due to the small number of Supreme Court Justices that have been given such a final authority over matters brought before the Supreme Court.
The intent of this amendment is to stop the sedition of the Supreme Court and to introduce checks and balances to the Judicial branch of the Oregon Government that do not exist today.
Only when the Supreme Court can be overturned by the People will the People’s voice be heard again and the Constitution have the authority that we all need for Oregon to survive.
Only when the Supreme Court can be overturned by the People will the decisions and rulings made by the Supreme Court stop being based on power or tyranny or be so easily accomplished by such a small number of people or foreign influences.
